有讀寫障礙的14歲中一生，從網上學習製造恐怖分子的常用炸藥，後來更導致同學炸傷手指。被告早前承認一項製造爆炸物品的罪名。裁判官判刑時指其父母過分保護被告，低估他在處理爆炸品時的能力，而被告亦曾攜帶爆炸品過關測安檢，對其他人潛在危機，判被告接受感化令18個月及留有案底，以收阻嚇作用。
辯方求情表示，被告有讀寫障礙，但在校成績有進步，只是有過分好奇心。被告事後承諾不會再在沒有人監管下做任何科學實驗，以免傷及群眾。被告父親亦為專業機械師，可向被告提供正確知識，故希望法庭輕判被告保護令，並運用酌情權撤銷控罪。
裁判官劉永成表示，被告曾在去年帶備與案中同類的炸藥TATP(三過氧化三丙酮)過境，企圖測試邊境的安全檢測裝置。劉永成直指被告行為危險，若遭人發現便成為另一宗刑事案，甚至會被視為恐怖分子。法庭的酌情權只是會就輕微控罪及被告在犯案前行為良好而作考慮，對今次案件，劉永成認為，感化令比保護令更能對被告及社會起到阻嚇作用。劉永成最後判以被告感化令，另須遵守宵禁令及在有需要時聽從感化官建議，接受心理輔導。
案發今年3月28日，一名13歲男童在住所試玩TATP時炸傷手指，傷者指炸藥由被告提供。警員後來到深水步拘捕被告，被告警誡下承認因貪玩而於網上學習製造炸藥，並曾製造過3次爆炸品。
14-year-old dyslexic bomb-maker placed on probation
A 14-year-old dyslexic Form One student learnt from the Internet how to make explosives used often by terrorists and caused the injury of two fingers of his classmate. The defendant had earlier pleaded guilty to the charge of making explosives. When pronouncing sentence, the magistrate said that his parents were overprotective and had underestimated their son's ability in handling explosive substances. The defendant had also previously carried explosives across the border to test the security check, which posed potential dangers to other people. The magistrate therefore deemed it necessary to sentence the young offender to probation for 18 months and to have a criminal record for deterrent.
In pleading for mercy, the defence lawyer said that the defendant had been making constant progress in studying even though he suffered from dyslexia and that the boy was simply being over-curious. The lawyer pointed out that the defendant had promised after the incident that he would never again do scientific experiments without supervision to avoid harming the general public; and the defendant's father, who is a professional mechanic, would be capable of offering proper knowledge. The lawyer asked the magistrate to give a lenient sentence of protection order and use his discretionary power to acquit the defendant.
Magistrate Lau Wing-shing said that last year the defendant carried the same explosive substance, triacetone triperoxide(TATP), used in this case across the border in an attempt to test the security equipment at the check-point. The magistrate spoke of this strongly as a dangerous act. If caught red-handed, the boy might get caught in another criminal case and be deemed a terrorist. The magistrate stressed that the discretionary power of the court can only be applied to minor offences and in cases where the accused had behaved well before committing the offence. He believed that a sentence of probation serves as a better deterrent than protection order to the defendant and the public. The defendant was finally sentenced to an order of probation. He will also have to comply with a curfew order and to receive psychological counseling when needed as advised by the probation officer.
The incident took place on 28 March when a 13-year-old boy got two of his fingers wounded at home as TATP went off during a trial. The injured named the defendant as the source of the explosives. Police officers later arrested the defendant in Sham Shui Po. He confessed to learning about making bombs online for fun and had made explosives in 3 different occasions. ■translation by 開明
